TVO Telethon Fundraiser 2024
Rules and Regulations

Commencing March 1, 2024, at 12:01pm (ET) until March 24, 2024, at 11:59pm (ET), (the “Telethon Fundraiser Period”), entrants (each, the “Entrant”) may enter the TVO Telethon Fundraiser (the “Fundraiser Contest”), in accordance with and subject to the following Fundraiser Contest rules (the “Rules”).

How to Enter:

No purchase necessary. You can enter the Fundraiser Contest in one of the following ways:

a. Early Bird: For each one-time charitable donation of at least $40.00, or monthly donation of at least $5.00, made online between March 1, 2024 at approximately 12:01pm (ET) and March 23, 2024 at approximately 12:00pm (ET) (the “Pre-Telethon Period”), the Entrant will automatically receive one (1) ballot into a draw for a prize in one of three categories of their choice to be drawn during the beginning of the live Telethon broadcast commencing at 6:30pm (ET) on March 23, 2024 ; plus one (1) ballot into a draw for the same prize to be drawn on Monday, March 25th, 2024, at 12pm EST, the day following the live Telethon broadcast. Prize categories are as follows: Attendance of a live “The Agenda” Taping; an NBA Prize Pack; a Retro TVO Swag Bundle. Please note that entries with donations of multiples of $40.00 will not receive multiple entries. Separate entries with donations of a minimum of $40.00 from the same Entrant, will be entitled to multiple ballots.

b. During Telethon: For each one-time charitable donation of at least $40.00, or monthly donation of at least $5.00, made online or by phone during the live Telethon (the “Telethon Period”) between March 23, 2024 at approximately 12:01pm (ET) and March 24, 2024 at 11:59pm (ET), the Entrant will automatically receive one (1) ballot into a draw for a prize in one of three categories of their choice to be drawn on Monday, March 25th, 2024, at 12pm EST, the day following the live Telethon broadcast: Attendance of a live “The Agenda” Taping; an NBA Prize Pack; a Retro TVO Swag Bundle. Please note that entries with donations of multiples of $40.00 will not receive multiple entries. Separate entries with donations of a minimum of $40.00 from the same Entrant, will be entitled to multiple ballots.

All entries submitted must include:

· Your full name;

· Confirmation that the Entrant is 18+;

· Your contact information — phone number and email;

· The name of the city or town where you live;

· Your answer to the skill-testing mathematical question;

· All requisite documentation.

Entries must be submitted to telethon.tvo.org, or by calling the donation hotline number, 1-800-463-6886, during the Telethon Period.

The Fundraiser Contest closes on March 24, 2024, at 11:59pm (ET). No submission will be accepted after the deadline under any circumstance.

Eligibility:

The Fundraiser Contest is open to all residents of Ontario, excluding employees of TVO.

The Fundraiser Contest is void where prohibited by law and is subject to all applicable federal, provincial, and municipal laws and regulations.

By entering this Fundraiser Contest, participants acknowledge that they have read and understand the Rules and accept and agree to be bound by these Rules, including eligibility requirements, and the decisions of are final, binding, and conclusive on all matters relative to this Fundraiser Contest.

Prizes:

The prizes available during each of the Pre-Telethon Period and Telethon Period are:

1. ONE OF TWELVE live “The Agenda” tapings, including a meet & greet and photos with the hosts (approximate value $800.00 each);

2. ONE of TWO NBA prize packs consisting of:

(i) Pre-Telethon Period: basketball autographed by the 2023 Raptors, plus two (2) tickets to a Raptors regular season game during the 2024/25 regular season (approximate value $350.00); or

(ii) Telethon Period: two (2) tickets to a Raptors regular season game during the 2024/25 season (approximate value $300.00);

3. ONE OF TWELVE bundles of TVO Retro Swag (approximate value $80.00 each).

Selection of Winners:

TVO reserves the right to substitute any prize (in whole or in part) with an alternative prize of equal value and/or specification, unless to do so would be prohibited by law.

There will be thirteen (13) random draws during the beginning of the live Telethon broadcast commencing at 6:30pm (ET) on March 23, 2024, to select the prizewinners from among all eligible entries during the Pre-Telethon Period. After each draw, the ballot chosen will not be re-entered into the Pre-Telethon draw. Odds of being selected depend on the total number of eligible entries during the Pre-Telethon Period. Winners will be contacted by email.

There will be thirteen (13) random draws on Monday, March 25th, 2024, at 12pm EST, the day following the live Telethon broadcast, to select the prizewinners from among all eligible entries during the Telethon Period. After each draw, the ballot chosen will not be re-entered into the Telethon draw. Odds of being selected depend on the total number of eligible entries received during the Telethon Period. Winners will be contacted by email.

During each of the Pre-Telethon Period and Telethon Period, there will be six (6) draws for The Agenda Taping, one (1) draw for an NBA Prize Pack and six (6) draws for the Retro TVO Swag Bundles.

Prize will be awarded upon receipt of the properly completed and executed declaration and release form by the winner and verification of identity. The selection of winners will be made available on the Telethon website.

General Conditions:

TVO is not responsible for incorrect or inaccurate entry or registration or entry information or any factor which may affect a person's ability to participate in the Fundraiser Contest, including but not limited to human error, technical malfunctions, lost/delayed/corrupted data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software or any combination thereof, any inability to access the telethon.tvo.org website, or damage to a user's system occasioned by participating in the Fundraiser Contest, and entries which fail to fully comply with these Rules.

No responsibility will be taken by TVO for the Entrant's inability to upload a file or connect through to the Internet/website during the Pre-Telethon Period and/or the Telethon Period. Prizes are non-transferable and must be accepted as awarded with no substitutions, whether in cash or otherwise. TVO reserves the right in their sole discretion to substitute a prize of equal or greater value if for any reason a prize or portion of a prize cannot be awarded as described.

TVO reserves the right to verify the validity and originality of any entry and/or Entrant (including an Entrant's identity and address) and to disqualify any Entrant who submits an entry that is not in accordance with these Rules or who tampers with the entry or winner selection process. Failure by TVO to enforce any of its rights at any stage does not constitute a waiver of those rights.

Right to Cancel or Suspend Fundraiser Contest

If for any reason the Fundraiser Contest is not capable of running as planned, due to infection by computer virus, bugs, worms, Trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of TVO that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Fundraiser Contest, TVO reserves the right, at its sole discretion, to disqualify any individual(s) who tamper with the entry/voting process, and/or to cancel, terminate, modify, or suspend the Fundraiser Contest.

Consent to Collect Personal Information

All personal information, such as name, address, telephone number, and email address submitted with an entry, is collected solely for the purposes of administering this Fundraiser Contest and, subject to the herein authorized uses, shall not be used for any other purpose without consent. By providing this information, and by submitting an entry form, all Entrants are hereby deemed to consent to their submitted information being used for the stated purposes. This consent includes, but is not limited to, receiving emails with regard to the Fundraiser Contest from TVO at the email address provided by the Entrant.

Consent to Rules

Entrants agree to abide by these Rules and by all decisions of TVO, which are final and binding with respect to all aspects of the Fundraiser Contest, including, without limitation, eligibility and/or disqualification of entries. TVO reserves the right to amend these Rules in its sole discretion, at any time, and without providing any notice. This includes TVO’s right to amend any dates referenced in these Rules.

Warranty and Limitation of Liability

By entering the Fundraiser Contest, all Entrants agree to release, discharge, and hold harmless the TVO and its partners, sponsors, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in this Fundraiser Contest or any Fundraiser Contest-related activities, the acceptance and use, misuse, or possession of any prize awarded hereunder and any herein authorized use of the Fundraiser Contest entry information.

TVO assumes no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to the Fundraiser Contest entries or entry forms. TVO is not responsible for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any entry to be received on account of technical problems or traffic congestion on the Internet or at any website, human errors of any kind, or any combination thereof, including any injury or damage to Entrants' or any other persons' computers related to or resulting from participation, uploading or downloading of any materials related to this Fundraiser Contest.

TVO accepts no responsibility for loss, damage or claims caused by the award prize or the Fundraiser Contest. By entering, each Entrant releases and holds harmless TVO and all of their respective directors, officers, members, employees, agents, successors and assigns from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the Fundraiser Contest.

These Rules and the rights and obligations and relations of the parties hereto shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Each party hereto does hereby attorn to the jurisdiction of the Courts of the Province of Ontario.
